LEGAL TERMS FOR PARTICIPATION IN “GUESS THE SCORE” OF THE GAME BETWEEN FC BARCELONA AND VILLARREAL

 (2020/2021 season)

 

 

RULE 1a. LOCATION.

 

FC BARCELONA, domiciled at Carrer Arístides Maillol, s / n, 08028 in Barcelona, ​​with CIF number G-8.266.298 (hereinafter FC BARCELONA or CLUB) promote a game called Guess the Score (hereinafter, “Guess the Score ”, The“ Game ”or the“ Action ”), available solely and exclusively to all those persons who: (i) are registered as ‘Culers’ (free or Premium membership), or those who have completed the subscription process for such purposes; (ii) participate in the “Guess the Score” game in accordance with the terms and conditions established in the rules.

 

The mechanics for participation and operation in the aforementioned action will be communicated and promoted on, among other FC BARCELONA communications tools, the club’s official website (www.fcbarcelona.com), on its social networks and on payment channels for third parties.

 

FC BARCELONA will run the Guess The Score game, which will be linked to the match on the opening day of the Liga Santander National Championship that will be played by FC Barcelona and Villarreal on September 27, 2020 (hereinafter, the "match").

 

Guess The Score will be made available to the interested parties via the website and FC BARCELONA's official applications, and will be duly identified and linked to the Match. Participation in Guess The Score shall be free of charge. FC BARCELONA reserves the right to cancel the draws for technical and/or operational reasons.

 

Once the game has been played there shall be two (2) draws (one for the free membership and another for the Premium membership) for each match played by FC BARCELONA, among all the members who have participated (regardless of whether or not they have guessed the corresponding match result).

 

The winners of the aforementioned draws will respectively receive the prize indicated in Base 6ª.

 

For the above purposes, in the case of underage participants, participation in the action in each of the corresponding phases described in these rules (acceptance of the rules, participation requirements, mechanics of the action, acceptance of the prize, etc.) must always be supervised by their parent or guardian etc. Therefore, according to the above, FC BARCELONA understand that consent and corresponding authorisations that are mandatory (acceptance of rules, participation requirements, mechanics of the action, acceptance of the prize, image rights, collection and handling of personal data, litigation, etc.) will be understood to have been given for all purposes and without reservation by the persons entrusted with their representation, guardianship and legal custody, on their behalf, and FC BARCELONA are exempt from any liability in this regard.

 

RULE 2a.- PARTICIPATION PERIOD AND PUBLICATION RULES.

 

The period for participation in Guess The Score will be determined at the sole and exclusive criterion of FC BARCELONA, which shall inform the interested parties thereof in good time on the basis on the date and time of the match.

 

These rules will be published on the official CLUB website (www.fcbarcelona.com) with the aim of letting all participants know about the method for participation and how the action works.

 

RULE 3a.- AUTHORISATION OF THE USE OF PERSONAL DATA.

 

  1. a) RESPONSIBLITY FOR PROCESSING: Your personal data will be processed by FC BARCELONA, located at Carrer Arístides Maillol s / n, 08028, Barcelona and with NIF G-08266298.

 

  1. b) PURPOSES: The data will be processed in order to manage the participation of the interested party in Guess The Score and in the draws, as well as to proceed, in the event that the participant is a winner, with the delivery of the prize and publishing of their data (name and surnames) on the official CLUB channels. Likewise, their data will be processed in order to register the interested party as a member.

 

  1. c) COMMUNICATION OF DATA: Your data will not be transferred, sold, loaned or made available in any other way to any third party, except for those service providers for FC BARCELONA, who carry out certain activities for the CLUB, but who in no case will process the data for their own purposes. Some of these suppliers may be located outside the European Union, as indicated below.

 

If you wish to receive information from third party companies, such as the FC BARCELONA Foundation or sponsors, this information will always be sent by FC BARCELONA, and we will not provide any data unless you have given us your express consent to do so.

 

  1. d) AUTOMATED DECISIONS AND PROFILING: For some services, we may process your personal data using automated means. This means that certain decisions are made automatically without human intervention. For example, we may segment persons according to whether they are interested in certain sections of FC BARCELONA, or use our services such as free Wifi in our facilities.

However, we may create a profile by analysing your behaviour on the website or showing you products that may be of interest to you, based on the preferences you have shown by browsing, or information obtained through cookies.

 

In addition, if you have agreed to receive commercial communications, they may be adapted and customised according to the interests of users, either based on the products and services requested, or based on data that we can deduce or obtain from browsing, interest in certain content or reaction to our communications.

 

This customisation is partially automated, in the sense that the CLUB determines the parameters of the customisation, but the technological platform generates the user profile. We do not send general communications that are not segmented through the previous procedure, as we consider that it is in the interest of both the CLUB and the user of the Barça Fans programme to send and receive information that is relevant. Non-segmentation would not alter the number of communications received from the Culers Membership program, merely its content. In this regard, if any user of the Culers Membership program does not wish to be segmented, please do not subscribe to receive communications for that programme.

 

 

  1. e) INTERNATIONAL TRANSFERS: FC Barcelona, as an international organisation, has international suppliers that may provide their services from outside the EU, so it is possible for users’ data to be processed outside the European Union or the European Economic Area (for example, the supplier of newsletter delivery, data storage, management of requests for information or member services, etc.).

 

In any case, the Club will ensure that this data processing is always protected with the appropriate guarantees, which may include:

 

  • Standard EU approved clauses: These are contracts approved by the European regulator, and which provide sufficient guarantees to ensure that the processing complies with the requirements of the European General Data Protection Regulation.

 

  • Third party certifications: For example, Privacy Shield, the framework agreement between the EU and the United States that establishes a standardized framework for data processing according to the requirements of the European General Data Protection Regulation.

 

  1. f) DURATION OF THE PROCESSING: All of the data that you provide to us shall be processed until the Club considers that, by any means available according to the technology available at any time, you are no longer interested in its products. In any case, you may unsubscribe from the newsletter at any time.

 

Likewise, all data provided to use during participation in the action shall be treated until the end of the same.

 

After the term indicated in the first paragraph of this section, FC Barcelona shall withhold your duly anonymized data for statistical purposes or market analysis, whenever possible, or duly blocked to comply with any legal obligation of the Club.

 

  1. g) EXERCISING YOUR RIGHTS: At any time you may revoke your consent to any of the uses of data indicated above.

 

Likewise, you may exercise your rights of access, rectification, deletion, opposition, limitation or portability through written communication addressed to Avda. Aristides Maillol, S/N, 08028, Barcelona (Spain), with the reference “Personal Data”, or by email to proteccio.dades@fcbarcelona.cat. 

 

If you have any doubts, questions or claims about the way we process your personal data, you may contact our Data Protection Delegate by email to dpo@fcbarcelona.cat or by mail to Avda. Aristides Maillol, S/N, 08028, Barcelona (Spain), with the reference "DPO". If you do not receive a response within a reasonable period (2 months) you may file a claim to the Spanish Data Protection Authority .

 

RULE 4. ENTRY REQUIREMENTS AND METHODS.

 

All those interested in participating in Guess The Score must comply with the requirements detailed below: 

 

  1. Start a session as a Culer (free or Premium). If you are not a Culer, you must become one through the registering process.
  2. Complete the Guess The Score game, predicting the result of the corresponding game.

 

RULE 5a.- DRAW MECHANISM.

 

After the Match, two draws will be made (one for the Culers with free membership and another for Culers with Premium membership) for each match played by FC BARCELONA among all the members who have participated in any of the Guess The Score competitions for matches (regardless of whether or not they got the result of the match in question correct). For these purposes, two (2) files will be created (one for each Culers membership format) containing the participants who meet these requirements.

 

In the event that there is no Culer that meets the aforementioned conditions, it will not be necessary to undertake the draw and the prizes will automatically be forfeited. In the event that there are more than two members of each of the membership formats, it will be necessary to carry out the draws (one for each match played by FC BARCELONA in the aforementioned competition).

 

Each of the Culers included in the files (free and Premium) will be assigned a sequential number in chronological order of participation, in order to have a consecutive range of numbers (e.g. from 1 to 50).

 

The draws will take place before a notary after the competition.

 

The draws (as many as there have been matches played by FC BARCELONA) will be carried out using a computer system that, according to a random combination assigned by computer, will randomly choose five (5) sequential numbers for each format assigned to the participants. The first of each format will be named “winners”, and the remaining four (4) “reserves”, with order of priority established according to the order of registration.

 

Once the draws have been held, the Notary will close the minutes stating the identification of the participants who have been named winners, as well as the reserves.

 

The result of the draws will be communicated to the winners by the contact email address provided by them for the purposes of participating, as well as information on the logistics of delivery and collection of the prize.

 

By participating in this Action, participants of legal age, and in the case of minors, parents or legal representatives of legal age who have been assigned legal custody thereof, EXPRESSLY ACCEPT (i) these conditions and, (ii) in the event that they are winners, accept the sending of an e-mail by the CLUB to the e-mail address provided by them for the purposes of participating, which will serve as a means of proof, to all effects, of the communication made by FC BARCELONA, informing about the situation. This contact will take place during the week following the draw. In the event that it is not possible to contact the winning participant within twenty-four hours (24 hours) from the time the first communication occurs, for any reason or circumstance outside the CLUB, the winner will lose their rights to the prize, with it being awarded to the first reserve and so on.

 

Participants awarded the prize must accept it, and in the case of minors this will be done by the parents or legal representatives of legal age who hold or have been assigned custody, expressly stating their acceptance or waiving. In the first case, it will be necessary to strictly follow the instructions provided by FC BARCELONA regarding the delivery logistics and, where applicable, the collection of the aforementioned prize.

 

RULE 6a.- PRIZE.

 

The winners of the free draw will receive a promotional code as a prize that will entitle them to a one year free subscription to Culers Premium Membership.

 

The winners of the Premium draw will receive the official FC BARCELONA shirt (without number and name printing) as a prize.

 

Once the prize has been sent or delivered to the corresponding winner, no change will be accepted.

 

BASE 7a.- ACCEPTANCE OF THE PRIZE.

 

The adult participant and, in the case of a minor, their legal representatives, who are declared winners by e-mail, must give an express answer prior to delivery and, where applicable, collection of the prize in question, indicating (i) their acceptance or (ii) their refusal of the prize with which they have been awarded:

 

  1. a) In the event of acceptance, the prize may be awarded under the conditions indicated by the CLUB to the winner, by signing a document containing the express acceptance of the corresponding prize and its reception, stating to have nothing to claim against FC BARCELONA.

 

In the case of an underage winner, acceptance of the prize must be made by their legal representatives on their behalf, in the terms set out in the previous paragraph.

 

  1. b) In the event of refusal or non-acceptance of the prize, this must be stated in writing. In the case of a minor participant being a winner, the waiving or non-acceptance of the prize, as applicable, must be made by their legal representatives on their behalf, in the terms set out above. In this case, the CLUB states that said prize may not be exchanged for another or for its cash value, with the first reserve automatically becoming the winner.

 

RULE 8a.- IMAGE RIGHTS

 

The winning participants and, in the event that they are minors, their legal representatives, give their express consent to FC BARCELONA, with absolute responsibility for all purposes, to capture their image (image, name and voice) through photographs and/or audiovisual recordings that may be made, individually or jointly through the staff of FC BARCELONA or third parties authorised by them, at the time of delivery of the aforementioned prize, for its use in advertising, as well as their participation in possible interviews and/or features that may be carried out. For such purposes, FC BARCELONA will be authorised to make use of the aforementioned graphic and/or audiovisual material, as well as copies, whether used in whole or in part, for promotional events and/or information relating to this action on any of the communication assets possessed by the CLUB worldwide for an indefinite period of time, renouncing any remuneration and/or claim under any circumstances, for the taking of said photographic images and/or audiovisual recording, its conservation, and the assignment of exploitation rights. In accordance with the above, media, advertising and promotional assets in which the image of the winner may appear (either individually or collectively), is and will be the property of FC BARCELONA.

 

All participants declare that they hold the full rights and legitimacy necessary for the granting of these authorizations, and accept responsibility for any claims from third parties that FC BARCELONA may receive for the use of the images authorised.

 

RULE 9a.- PRESENTATION OF RULES BEFORE A NOTARY.

 

The rules will be presented to a notary from the l’Il·lustre Col·legi de Notaris de Catalunya.

 

BASE 10a.- ACCEPTANCE OF RULES

 

Participation in the aforementioned Action implies the express and complete acceptance without reservation of:

 

  1. a) These rules.
  2. b) The mechanics of participation in the Guess The Score game and in the draws.
  3. c) The use and processing of the personal data of the interested parties participating, in the terms established in these terms and conditions.
  4. d) The sending of electronic communications for commercial purposes, provided that the participant has given his/her express consent to such effect.
  5. e) The use, dissemination and publication of photographs and/or audiovisual recordings in the terms established in these terms and conditions.

 

In the event of any dispute over the Action and/or the interpretation of these rules, the Courts and Tribunals of Barcelona city will me the governing authority. Participants in this Action expressly waive any other jurisdiction that may apply to them.

 

In the event that minors participate in the Action, it will always be with the consent of their parents and/or an adult who has custody of them.

 

RULE 11a.- COMMUNICATION OF THE ACTION.

 

The communications regarding the present Action and, where applicable, those relating to the draws will be described in the communication channels of FC BARCELONA, such as the official website of the CLUB (www.fcbarcelona.com), where these rules can also be consulted.
